§1 No registration fee – Social Media
Kapitel Zwei doesn’t charge you any registration fee. Use your valuable time to write a feedback after your German course on social media platforms, (such as Google, Facebook, Twitter or Instagram, etc.) if you enjoyed the lessons, or if you liked the leachers and the school. You are free to write your text about our school, your German course or Berlin in any language. The text entries can be a post or a tweet as well. Please send us your input/article (as a link) via email.
§2 German classes
§2.1 Contract with Language School
Registration via our registration form does not constitute a legally binding declaration of contract. After receiving the request via the form, we will contact you by email. A valid email address must be provided to communicate all booking related details with the participant.
The contract starts with sending a binding reservation to the email address, given in the form. The course and/or examination fees stated in the reservation email, are to be paid by the stated reservation date, depending on the selected offer. If the reservation date is not met, Kapitel Zwei reserves the right to automatically terminate the contract without further notice. Possibilities for rebooking, cancellation or other changes for the booked courses can be found in §5. German law applies.
§2.4 Minimum Number of Participants
A minimum of five paying participants is required for German course to take place. If the necessary numbers failed to be recruited, “Kapitel Zwei. Deutsch-Sprachschule Berlin GmbH” reserves the right to:
- either delay the start of the course
- change the time of the sessions
- shortening of the German language course
- offer an alternative
- cancellation and a refund of the course fee.
§2.6 Discounts
Any form of cancellation, postponement or refund is excluded.
Discounts only apply to the promotions within the
- listed tariffs
- specified periods (*not retroactive) and
- Addressees (regular customers or new customers of a certain month).
In particular, discounts and special offers do not apply to:
- for combining two or more promotions.
*Transferring a promotion to another party is not possible.
“Kapitel Zwei. Deutsch-Sprachschule Berlin GmbH” will advise you of any change in date, duration or cancellation no later than two days prior to start of the course. If you disagree with any of the amendments made to the course, you shall be provided a full refund. The tutor has the right to arrange for alternative dates in consultation with the participants.
Should attending our courses within our premises no longer be possible due to
a) organisational reasons or
b) to a pandemic (e.g. a virus), Kapitel Zwei reserves the right to switch the entire school programme to online teaching. Cancellation or rebooking are excluded in this case.
The offer of virtual classes is completely equivalent to the offer of real classes: same time, same duration, same period, same level, same content, knowledge of German at the end of the course identical to regular in-class lessons.
Miscellaneous: Catch up date
A possible cancellation of the lesson due to illness of the teacher will be announced via e-mail. Alternatively, we can organize an adequate replacement or a catch-up date (online with zoom or on-site at school).
The cancelled lessons can be made up for at another time agreed by the teacher and the participants. The alternative date will take place if 80% of the course participants confirm their participation in a democratic vote. Alternatively, we offer you an alternative date in our grammar or conversation courses (online or in person) – if you participate within 12 months.
A refund of the fee for the cancelled lesson is not possible.
If you are unable to attend an event at short notice, you are not entitled to a catch-up date.
§4 Terms of payment
The course and exam fees must be paid in full by yourself in advance, either in cash or by (debit or credit) card in the office or by bank transfer or PayPal.
Payment by American Express, VPay, Diners Club, etc. is not possible! We do not accept any payments made by Western Union. Please inform yourself about any incurring bank charges. “Kapitel Zwei. Deutsch-Sprachschule Berlin GmbH” will not bear any of these costs (neither for a money receipt, nor for a refund/return transfer).
You will receive a booking confirmation for your class prior to payment.
You will receive an invoice/receipt after settlement of the charges.
§4.2 Unauthorized participation
If we suspect any unauthorized person participating or having participated in our courses, we will exclude the person (A), who allowed person B to participate without an official course booking, from the school program.
Additionally, person A will be charged for the full course fee (the amount of a regular Classic rate) for person B.

Cancellation
In the Classic course tariff you can cancel your course up to 14 days before the start of the course, via email. We will then refund 80% of your course fees. After that, any form of cancellation, postponement or refund is excluded.
All other tariffs do not include rebooking or cancellation.
Kapitel Zwei does not cover transfer fees.
Rebooking
In the Classic course tariff you can rebook your course up to 14 days before the start of the course, via email. There will not be a second rebooking or goodwill action in any form. We will then refund 80% of your course fees.
All other tariffs do not include rebooking or cancellation.

Rebooking for an indefinite period of time
It is not possible to rebook for an indefinite period of time. If you refuse to provide new booking data, the current booking will be given the pending status of a voucher. The validity of a voucher is a maximum of 6 months (see § 2.7) from the day of the request to rebook.
Transferring your booking to another person, in any way, is not possible
Expiry of the 14 days
If you want to cancel or rebook after the deadline, if you do not attend the course or if you need to leave the course during the term of the course, we will not refund any fees.
The cancellation of a telc exam is only possible up to 14 days (until 3.30 pm / UTC+1) before the exam date. Should this be the case, we will refund 80% of your exam fees.
Rebooking a telc exam is only possible once per person and free of charge, up to 14 days (until 3.30 pm / UTC+1) before the exam date.
We will not carry out a second change (rebooking, cancellation or courtesy). In this case you do get the 80% of the exam fee back by bank transfer. Kapitel Zwei does not cover transfer fees.
Rebooking or cancellation after the deadline is no longer possible. In this case, you are liable to pay the entire amount in full.
If you do not appear on the day of the exam day or have to leave during the exam time, this is only possible with a certificate on/for the exam day. You must submit it by the first Monday after the exam / two days after the exam. If the telc institute accepts the certificate, we offer two options:
a) A refund of 80% of your exam fees.
b) We will rebook you once only for another exam day – for a fee of 20 EUR. There will not be a second rebooking or goodwill action in any form. In this case, you will receive a refund of 80% of your examination fees.
Kapitel Zwei does not cover any transfer fees.
Submission of a medical certificate for the same exam is only possible a maximum of 3 times. We will not accept a fourth certificate, however, in that case we will refund 80% of your exam fees.
A visa application can take time and is sometimes not approved by the time of the deadline. We therefore recommend our Classic tariff.
If you do not get your visa, you can cancel your booked course within 7 working days before the start date, by presenting the official rejection notice from the official authority. In this case, we will refund 80% of your course fees.
Each person can rebook twice in due time free of charge.
We will not carry out a third change (rebooking, cancellation or courtesy). In this case you do get the 80% of your already paid amount back by bank transfer. Kapitel Zwei does not cover transfer fees.
If you do not attend the course or need to leave during the course, you must pay the total invoice amount in full.
e) Right of withdrawal (after school program start)
“Kapitel Zwei. Deutsch-Sprachschule Berlin GmbH” does not offer a “basic 14-day right of withdrawal” for the entire school program. We are referring to exceptional cases in accordance with the German Civil Code (BGB). The entire school program is subject to limited places for a fixed period. In this non-classic case, a revocation is unreasonable for the provider. (LG Bielefeld, judgment of 05.06.2012, Az .: 15 O 49/12)

§7 Visa
Once you have paid the course tuition for the first month, we will send you the official confirmation (fees ->) and upon request, the contract with the language school for the Embassy. The registration confirmation also includes the reservation for all the follow-up courses and months. Should you need more months for your application, we can reserve the follow up courses for the next months. This corresponds to payment by instalments.
§8 Course confirmation for #offline courses
A free course confirmation is issued to every participant after completion of the classes.
§9 Private lessons
You can postpone/rebook/change a single class from the scheduled set of your individual lessons, maximum twice up to 24 hours before the agreed lesson, on weekdays (Mon-Fri during opening hours). For individual lessons on Monday, the deadline is usually the Friday before. If you cancel less than 24 hours in advance, you will be charged the full course fee.
You can cancel the entire booking up to 7 days before the first agreed date and receive a refund of 80% of the course fees.
If you want to cancel a booked 5 or 10-pack package on time, you will be charged for the hours already completed at the unit price and the remaining amount will be reimbursed.
§10 Liability
Kapitel Zwei Berlin assumes no liability for liability cases (e.g. accidents or damage, etc.) neither on the way to the school (e.g. courses, exams, events) nor during or afterwards. Participants are liable for all damage they cause and are obliged to provide compensation in accordance with the current legal provisions. Kapitel Zwei is not liable for any damage.
Legal guardians are liable for minors!
Course and exam participants are not covered by any accident or health insurance held by “Kapitel Zwei. Deutsch-Sprachschule Berlin GmbH”.
With your registration at “Kapitel Zwei. Deutsch-Sprachschule Berlin GmbH” you confirm that you have taken out an internationally valid liability insurance policy for yourself, which covers all costs in the event of damage caused by you. This includes, for example, “fire, explosion, water, electrical damage, burglary, theft, personal injury, property damage and financial loss.
The participation in our courses, exams and in our leisure program is at your own risk. “Kapitel Zwei. Deutsch-Sprachschule Berlin GmbH” cannot be held liable for any accidents, damages or cancellation of classes arising from force majeure or strike by the existing transport companies. “Kapitel Zwei. Deutsch-Sprachschule Berlin GmbH” cannot be held legally responsible for lost, damaged or stolen property.
§11 Health and accident insurance cover
It is your personal responsibility to arrange for health and accident insurance cover as part of your stay in Berlin/Germany. “Kapitel Zwei. Deutsch-Sprachschule Berlin GmbH” recommends you to contact “Care Concept“.
§12 Damage liability
If you have booked accommodation, you can be personally held liable for any damages which may arise during your stay. We reserve the right to charge a deposit. Furthermore you’re obliged to leave the rented room in a neat and tidy condition on the day of your move (which is always on a Friday). All rented items will have to be returned to their original location. Please note that you have to have left the apartment by 10am.
§15 Correctness of information
You hereby certify that the information in your application form are true and correct to the best of your knowledge. You will not be reimbursed the course fee if you have been misclassified based on incorrect information or due to any assistance provided during the placement test.
§17 Books
Course books can be purchased at reception on the first day of the course. We no longer offer the lending of our work and course books. In some courses a small fee for copies is required in order to improve your German language.
There is no entitlement to (a download or print version of) teacher’s notes taken during the course. Course-related supplementary material may be provided individually and voluntarily by the teacher during the course. After the end of the course, these additional materials will be deleted in accordance with data protection regulations.
For successful German learning, we recommend that you always take your own notes and complete the exercises in the course books and workbooks.
§18 Pictures
Given to a prior announcement “Kapitel Zwei. Deutsch-Sprachschule Berlin GmbH” reserves the right to take pictures of study groups as well as individual learners during classes or extracurricular activities and use them for advertising purposes.

§I Special Paragraph: Corona / Covid-19
You accept the complete hygiene and safety guidelines for teaching / learning during the corona pandemicie.
In order to contain and protect against the SARS-CoV-2 viruses (#Corona), which are currently circulating, you are obliged to wear a ffp2 or medical mask covering permanently in our language school throughout the school building. This also includes wearing a mask in the classroom while seated.
A face shield or fabric mask is not sufficient. If you are not allowed, due medical or health reasons, to wear a ffp2 or medical mask (# medical prescription), we recommend our attractive online courses.
You affirm that you have not knowingly had any contact with a Cov19 positive tested person, before going to school.
You assure that you will not take part in offline lessons and stay at home, if you show severe cold symptoms (even without fever).
You ensure that you have not entered a risk area within the last 14 days prior to starting your offline course. If so, please follow the current quarantine regulations.
You assure that you will take longer drinks and food breaks in the open air.
Under Paragraph 3 you will find more information in the case of people who tested positive or switching from offline to online lessons.
Cancellation, of a school offering that takes place in person, is not possible when the 1G/2G/2G+ or 3G rules are changed.
Privacy Policy
After signing in, the data traffic between the HotSpot of Kapitel Zwei and your device is transmitted unencrypted and does not guarantee the privacy and confidentiality of information. Sensitive material transferred over the Internet may be at risk of detection by a third party. It is your own responsibility to protect your data (by using a firewall, anti-virus software, regular data backup etc.) and to encrypt your data (eg https, VPN).
a) Misuse of the HotSpot by you
The HotSpot provider (Kapitel Zwei GmbH) appears as a neutral technical intermediary and has no control over transmitted contents. You are responsible for the Internet content that you are accessing over the hotspot and/or distributing or which you make available to the public. A content monitoring through the HotSpot provider does not take place. The user is obliged not to misuse the HotSpot.
Among others, misuses of the HotSpot are as follows::
- violation of any patent, trademark, trade secret, copyright or other proprietary rights of any party, use of Peer-to-Peer Networks e.g. illegal file-sharing
- Using the service to transmit/publish any material that, intentionally or unintentionally, violates any applicable local, state, national or international law, or any rule or regulations promulgated thereunder. And sending bulk and/or commercial messages and viruses.
- publication of data which promotes or encourages illegal or socially unacceptable or irresponsible behaviour; including links to websites containing such content
- violate the WiFi Network’s security or any third party’s system or network security by unauthorised access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network (hacking)
- Using the Service for any activity which adversely affects the ability of the system, network services or network equipment or structur of the hotspot server of the hotspot provider
b) Indemnification
You shall defend, indemnify and hold Kapitel Zwei GmbH harmless from and against, and shall promptly reimburse them for, any and all losses, claims, damages, settlements, costs, and liabilities of any nature whatsoever (including reasonable attorneys’ fees) to which any of them may become subject arising out of, based upon, as a result of, or in any way connected with, your use of the Wi-Fi System or any breach of this Agreement. Anyone who believes that there is or will be a violation of these terms of use, must direct the information immediately to the HotSpot provider.
c) Miscellaneous
The above conditions define the hotspot usage between the HotSpot provider (Kapitel Zwei GmbH) and you as a user. Verbal collateral agreements do not exist. Law of the Federal Republic of Germany applies.
All users (including yourself) acknowledge and agree that Kapitel Zwei GmbH will log any internet activity for any IP/Mac address of any device (laptop, mobile/cell phone, tablet, etc) for the protection of this directive and the above-mentioned legal requirements Thus, the liability, of all of your activities mentioned under section 2, will be transferred to you as a user.
